Article 9    (Prohibited Acts)
Users shall not engage in the following acts concerning the use of the Services:
(1)    Acts violating these Terms and Conditions.
(2)    Acts violating laws and regulations or acts related to criminal activities.
(3)    Acts related to antisocial activities, or providing benefits to antisocial forces.
(4)    Acts infringing on the intellectual property rights, portrait rights, privacy rights, honor, or other rights or interests of the Company or a third party.
(5)    Acts imposing excessive loads on the Company’s network or systems, etc.
(6)    Acts of unauthorized access to the Company’s network or systems, etc., or attempting unauthorized access.
(7)    Acts of using other users' user information or reservation numbers or allowing their use.
(8)    Unless explicitly permitted in these Terms and Conditions or otherwise permitted by the Company, acts of reproducing, selling, publishing, or otherwise using information obtained through the Services.
(9)    Acts disrupting the operation of the Services, or acts that damage or may damage the credit of the Company.
(10)    Acts of modifying, deleting, decompiling, disassembling, or reverse engineering programs related to the Services or the Company’s website, or using network monitoring or detection software to determine the site architecture of the Company’s website.
(11)    (Acts that disrupt or compromise the consistency or security of the Service’s systems, or attempt to decipher transmissions to or from the servers running the Services.
(12)    Acts of uploading invalid data, viruses, worms, or other software agents through the Services.
(13)    Unless explicitly permitted in these Terms and Conditions or otherwise permitted by the Company, acts of using the Services for commercial purposes or for the benefit of third parties.
(14)    Acts that directly or indirectly induce or facilitate the acts in the preceding items.
(15)    Other acts deemed inappropriate by the Company.

Article 10    (Changes, Suspension, and Interruption of the Services)
1.    The Company can change the contents of the Services or cease to provide them at its own discretion. If the Company decides to terminate the provision of the Services, the Company will notify users in advance.
2.    The Company may temporarily suspend or interrupt the provision of all or part of the Services without prior notice to users in any of the following cases:
(1)    When performing regular or emergency inspection or maintenance work on the computer systems related to the Services.
(2)    In case the provision of the Services becomes difficult due to computer or communication line failures, erroneous operations, excessive concentration of access, unauthorized access, hacking, or other unforeseen factors.
(3)    If a security issue arises regarding the Services.
(4)    In case the operation of the Services becomes impossible due to force majeure, such as earthquakes, lightning, fires, wind and water damage, power outages, natural disasters, epidemics, or outbreaks of infectious diseases.
(5)    When the lawful operation of the Services becomes difficult.
(6)    In other cases where the Company reasonably determines that suspension or interruption of the Services is necessary. 
3.    Except in cases where the Company is intentional or negligent, the Company shall not be liable for any damages incurred by users due to measures taken by the Company based on this article.

Article 11    (Termination)
1.    If the user falls under any of the following reasons, the Company may, without prior notice or demand to the user, temporarily restrict the use of the Services by the user, and/or terminate the contract related to the use of the Services.
(1)    Violation of any provisions or guaranteed matters of these Terms and Conditions.
(2)    If applicable to any of the reasons for use refusal set forth in each item of Article 4, Paragraph 2.
(3)    If there is a suspension of payment or insolvency, or if a petition for commencement of bankruptcy proceedings, civil rehabilitation proceedings, or procedures similar thereto has been filed.
(4)    If a resolution or decision to commence dissolution or liquidation proceedings has been made. 
2.    If the user falls under any of the reasons mentioned in the preceding paragraph, they shall lose the benefit of the term for all debts owed to the Company and shall immediately pay all debts to the Company.
3.    Except in cases where the Company is intentional or negligent, the Company shall not be liable for any damages incurred by the user due to measures taken by the Company based on this article.

Article 12    (Intellectual Property Rights, etc.)
All intellectual property rights related to the Services belong to the Company or those who have granted permission to the Company to use them. The permission to use the Services does not imply a license to use the intellectual property rights related to the Services.

Article 13    (Disclaimer and Indemnification)
1.    The Company shall not be responsible for the services, information, and management of personal information provided by third parties who are providers of external services integrated with the Services, except in cases where the Company is intentional or negligent.
2.    Users shall, at their own expense and responsibility, address and resolve any transactions, communications, disputes, etc. that arise between travel operators, other users, or other third parties in connection with the use of the Services, and the Company shall not bear any responsibility, except in cases where the Company is intentional or negligent.
3.    Users shall indemnify the Company or its affiliates for all losses, expenses, damages, debts, etc. incurred in connection with the user's actions that violate these Terms.

Article 14    (Damage Compensation)
In the event that these Terms constitute a consumer contract under the Consumer Contract Law and damage occurs to the user due to the Company's intentional or negligent act, the Company shall be liable for damages based on non-performance of obligations or tort. In this case, except in cases where the Company has intention or gross negligence, the Company shall be responsible for compensating only for direct and ordinary damages actually incurred by the user and shall not be liable for damages arising from special circumstances (including cases where the occurrence of damage is foreseen or could have been foreseen).

The Company will handle user personal information in accordance with our privacy policy (https://japan-boost-travel.com/●●). The user agrees that the Company will handle personal information in accordance with this privacy policy.


Article 16    (Contact Information)
Communications, notifications, etc., from the Company to the user regarding this service will primarily be conducted through the service's interface or to the email address provided by the user to the Company.

Article 17    (Confidentiality)
1.    The user shall confirm and accept that they will handle information disclosed by the Company to the user with confidentiality, unless there is prior written consent from the Company to handle said information otherwise.
2.    The user, whenever requested by the Company, must return or dispose of, without delay and in accordance with the Company's instructions, the confidential information referred to in the preceding paragraph, as well as all documents and other recording media containing or recording such information and all copies thereof.

Article 18    (Assignment)
Users and the Company shall not assign, transfer, provide as security, or otherwise dispose of their status under the user agreement or rights or obligations arising from the user agreement to a third party without the written consent of the other party. 

Article 19    (Severability)
Even if any provision or part thereof of these Terms is determined to be invalid or unenforceable under applicable law, the remaining provisions or parts thereof of these Terms shall continue to be fully effective. The Company and the user shall endeavor to amend the invalid or unenforceable provision or part to the extent necessary to make it valid and enforceable, striving to preserve the intentions behind and ensure legal and economic equivalence with the invalid or unenforceable provision or part.

Article 20    (Governing Law and Jurisdiction)
1.    Japanese law shall govern these Terms and Conditions and the use of this Service.
2.    For all disputes arising out of or in connection with these Terms or the use of this Service, the Tokyo District Court shall be the court of first instance and have exclusive agreed jurisdiction.
