Article 9.(Process for User Account Password Abuse)
If the Company receives a notice from User as described in Paragraph 7 of Article 8, the Company shall temporarily suspend the processing of transactions and subsequent use of the account as soon as possible.
Article 10.(System Security)
1. The Company ensures that the computer systems with which it transacts business with its User are reasonable and expected to be secure relative to the technology available at the time of entering into and executing the contract.
2. Should the Company detect a possibility of leakage of User' personal information or damage to User due to a cyber-attack or system defect in the above system, the Company shall immediately take effective security measures and promptly notify User who may have suffered damage by e-mail or by other means.
Article 11. (Prohibitions)
User shall not engage in any of the following acts with regard to the use of the Service.
(1) Violation of these Terms and Conditions
(2) Actions that violate laws and regulations or are related to criminal acts.
(3) Actions related to antisocial activities or provision of benefits to antisocial forces.
(4) Infringement on the intellectual property rights, portrait rights, rights of privacy, honor, or any other rights or interests of the Company or any third party.
(5) Action that imposes an excessive load on the Company's network or system, etc.
(6) Unauthorized access or attempted unauthorized access to the Company's network or systems, etc.
(7) Using or allowing another User's information or reservation number to be used by another User.
(8) Duplication, sale, publication, or any other use of information obtained through the Service, except as expressly permitted under these Terms or as otherwise approved by the Company.
(9) Actions that obstruct the operation of the Service or damage the Company's credibility, or actions that have the potential to damage the Company's credibility.
(10) Modifying, deleting, decompiling, disassembling, or reverse engineering programs related to the Service or the Company's site, or using network monitoring or detection software to determine the site architecture of the Company's site.
(11) Actions that interfere with or impair the consistency or security of the system of the Service or attempt to decipher transmissions to or from the server running the Service.
(12) Uploading invalid data, viruses, worms, or other software agents through the Service.
(13) Use of the Service for commercial purposes or for the purpose of benefiting a third party, except as expressly permitted under these Terms or as otherwise approved by the Company.
(14) Actions that directly or indirectly cause or facilitate any actions listed in each of the preceding items.
(15) Other actions that the Company deems inappropriate.
Article 12.(Notes on AI Chat Service)
1. Due to the technical limitations of AI language processing, there may be cases in which AI answers are not accurate, contain inappropriate expressions or incorrect information or are unable to properly answer questions.
2. Do not enter any personal information during the course of conversation with the AI Chat Service.
3. The information provided by the AI Chat service shall be for reference only; Users must make their final travel plan decisions based on their own circumstances and assume the risk thereof.
Article 13.(Modification, Suspension and Termination of the Service)
1. The Company may, at its discretion, change the contents of the Service or terminate the provision of the Service. In case the Company terminates the provision of the Service, the Company shall notify the User in advance.
2. The Company may, without prior notice to Users, temporarily suspend or discontinue the provision of all or part of the Service in any of the following cases.
(1) When inspecting or maintaining the computer systems involved in the Service on a regular or urgent basis.
(2) When provision of the Service becomes impractical due to computer or communication line failures, malfunctions, excessive concentration of access, unauthorized access, hacking, or other unforeseen factors.
(3) When security problems related to the Service arise.
(4) When the Service can no longer be operated due to force majeure such as earthquake, lightning, fire, windstorm, flood, power outage, natural disaster, pandemic of disease or infectious disease, etc.
(5) When the Service can no longer be operated within applicable law.
(6) When the Company reasonably determines that suspension or termination of the Service is necessary for any other reason.
3. The Company shall not take any responsibility for any damage incurred by User as a result of changes to or suspension of the Service taken in accordance with the provisions of Article 1 or Article 2 of this provision, unless such damage is caused by the Company's intentional misconduct or gross negligence.
Article 14.(Termination)
1. The Company may, without prior notice or demand, temporarily restrict a User's use of the Service or terminate the contract regarding the use of the Service if the User falls under any of the following items.
(1) Violation of any of the provisions of these Terms and Conditions or any of the assurances provided herein.
(2) If any of the reasons for denial of use listed in each item of Paragraph 2 of Article 4 is applicable.
(3) In case of a court order for civil rehabilitation or declaration of bankruptcy, a settlement under the Bankruptcy Law, or an order for dissolution, suspension of business, or closure of business by the competent authority due to violation of laws and regulations.
(4) In case of resolution of dissolution, petition for bankruptcy, suspension of transactions by banks, refusal to pay bills, suspension of payments, or other circumstances reasonably deemed to cause impaired credit.
2. If User fails to comply with any of the items of the preceding Article, User shall forfeit the benefit of time with respect to all debts owed to the Company and shall immediately pay all debts owed to the Company.
3. The Company shall not be responsible for any damages incurred by User as a result of actions taken by the Company pursuant to this Article, except in the case of intentional or gross negligent conduct by the Company.
Article 15.(Intellectual property rights)
All intellectual property rights related to the Service are the property of Company, and the granting of a license to use the Service does not imply the granting of a license to use any intellectual property rights related to the Service.
Article 16.(Disclaimer and Indemnification)
1. The Company shall not be responsible for the management of services, information, or personal information provided by third parties who are providers of external services linked to the Service, except in cases of intentional or gross negligent conduct by the Company.
2. The User shall, at their own expense and responsibility, handle and resolve any transactions, communications, disputes, etc. with travel agencies, other Users, or other third parties in regard to use of the Service. The Company shall not be responsible for any such transactions, communications, disputes, etc. except in the case of the intentional or gross negligent acts or omissions of the Company.
3. The User shall be liable to compensate the Company or its affiliates for any loss, expense, damage, or debt incurred by the Company or its affiliates due to the User's violation of these Terms.
Article 17(Disclaimer for AI Chat Service)
1. The Company shall not guarantee, for any reason whatsoever, the accuracy or up-to-datedness of any information presented through the use of the AI Chat Service.
2. The Company shall not be obligated to store the content of Users' chats via the AI Chat Service and shall not be obligated to disclose the content of chats to Users.
3. The Company shall not be responsible for the accuracy or legality of the content of third-party links included in the AI Chat Service. The Company shall not be concerned with any rights, obligations, or compensation arising out of Users’ use of or dealings with such third-party links.
4. The Company shall not be responsible for any problems related to availability of or access to the AI Chat service, nor for any direct or indirect damages resulting therefrom.
Article 18.(Damages)
The Company shall be responsible for damages based on default or tort in any case where the Company intentionally or through gross negligence violates these Terms and damages are incurred by the User. In this case, the Company shall be responsible only for direct and ordinary damages actually incurred by the User, and shall not be responsible for damages arising from special circumstances (Including cases where the Company anticipated or could have anticipated the occurrence of damages), except in the case of intentional misconduct or gross negligence by the Company.
Article 19.(Privacy)
The Company handles Users' personal information in accordance with the Company's Privacy Policy (https://japan-boost-travel.clicugo.com/C/tw/loadNewsDetail/privacy_policy). The User agrees to Company's handling of personal information in accordance with this Privacy Policy.
Article 20.(Contact Information)
In principle, communications, notifications, etc. from the Company to the User concerning the Service shall be made through the Service screen or to the e-mail address provided by the User to the Company.
Article 21.(Confidentiality)
1. User acknowledges and agrees that the Company shall treat any information disclosed to User in confidence, except with the prior written consent of the Company.
2. Upon request of the Company, the User shall, without delay and in accordance with the Company's instructions, return or destroy the Confidential Information, the documents and other recorded media containing or recording such information, and all copies thereof, at any time and in accordance with the Company's instructions.
Article 22.(Assignment)
Neither the User nor the Company shall assign, transfer, grant a security interest in, or otherwise dispose of the User's position under the Service Agreement or rights or obligations under the Service Agreement to any third party without the written consent of the other party.
Article 23.(Severability)
If any provision or part of these terms and conditions is determined to be invalid or unenforceable under any law or regulation, the remaining provisions or parts of this terms and conditions shall continue to be in full force and effect. The Company and User shall endeavor to modify such invalid or unenforceable provision or portion to the extent necessary to make it legal and enforceable, and to ensure that the intent of such invalid or unenforceable provision or portion and its legal and economic effect are equivalent.
Article 24.(Consumer Dispute Resolution)
If User has any dissatisfaction with the Company's services, please contact the Company via e-mail (include the User's address).
Article 25.(Applicable Law and Jurisdiction)
1. These Terms and use of the Service shall be governed by and construed in accordance with the laws of Japan.
2. The Tokyo District Court shall have exclusive jurisdiction in the first instance over any and all disputes arising out of or in connection with these Terms or use of the Service.
